營所稅未繳納不得分配給股東扣抵

財政部表示，依所得稅法第66條之3規定，營利事業繳納屬87或以後年度我國營所稅結算申報應納稅額，計入股東可扣抵稅額帳戶的日期，如是以現金繳納者，為繳納稅款日；以暫繳稅款抵繳結算申報應納稅額者，為年度決算日。

財政部強調，結算自繳及暫繳稅款計入時點雖有不同，但前提必須均已繳納，如果稅款尚未繳納，千萬不能提前計入「股東可扣抵稅額帳戶」，否則將會虛增帳戶金額，造成股東的可扣抵稅額超額分配，被查獲者除補稅外，還要另按超額分配金額，處一倍以下罰鍰。
