開刀後上班被要求休無薪假　判員工獲資遣費

胡姓女子去年任職一間印刷大廠時，請假住院開刀，取出4年前車禍的骨釘，胡女指控，公司不發給她休假前3個月的加班費共35404元，10天後胡女銷假上班，公司又以他休假太多、開刀太突然為由，要求她休無薪假，胡訴請公司給付資遣費及未付工資共15萬餘元，並發給他非自願離職書。

但公司認為，胡女上班時常打電動，等到下班後再加班，希望她說明改進後再補發加班費，台北地院認為，公司無法證明胡女上班打電動，且未發加班費又要求休無薪假，已違反《勞基法》，判公司應付胡女15萬餘元，並發給她非自願離職書。全案仍可上訴。
