公務人員退休法：
第五條公務人員任職滿五年以上，年滿六十五歲者，應予屆齡退休
第十四條：
第一項公務人員退休撫卹新制自中華民國八十四年七月一ㄖ起實施
第六項公務人員依規定不合退休、資遣於中途離職者，得申請一次發還其本人原繳付之退撫基金費用本息
第二十七條請領退休金、資遣給與、離職退費、撫慰金等之權利，自請求權可行使之ㄖ起，因五年間不行使而當然消滅
